TERMS OF SERVICE

1. Scope

I create digital illustrations: character art, cover illustrations, endpapers, sprayed edge artwork, and special edition art. I only create the illustration. I do not provide typography, cover layout, or print-ready files (templates, bleed, spine, CMYK setup). Your designer or publisher takes care of those.

2. Booking

1. Choose a slot from my Free Slots list and send me your project details (story, characters, mood, references, intended use, deadline).

2. I confirm availability and send a quote, valid for 14 days.

3. Your slot is secured once you accept the quote and the deposit is paid.

Details and references can be refined until I start your project. I may decline any request without giving a reason.

3. Payment

• Deposit: [50]% of the total price, due within 7 days of accepting the quote. It secures your slot and is non-refundable.

• Second payment: the remaining 50% is due once you approve the final sketch, and is also non-refundable. Rendering starts only after full payment.

• If a payment is overdue by 7 days and I hear nothing, your slot is released to the next person on my waitlist.

• Prices are in EUR. Payment via PayPal / bank transfer. An invoice is issued after payment. [ small business.]

• The quoted price for your commission stays fixed, even if I adjust my prices later.

4. Process and Revisions

You receive previews at three stages: 1. sketch, 2. colored draft with lineart, 3. final rendering.

• Each stage includes [2] revision requests. Please give clear, detailed feedback.

• I never continue to the next stage without your approval.

• At the final stage, only small adjustments are possible. Changes to pose, characters, or composition after sketch approval, and extra revision rounds, are charged at [10 €] per round.

5. Timeline and Communication

After the sketch is approved, I typically need 2-3 weeks for the final artwork, depending on how quickly you respond. Deadlines are confirmed in writing, and rush orders may carry a plus 25–50% fee. Illness or other emergencies can delay delivery, and I'll tell you right away.

Good communication keeps things smooth on both sides. If I don't hear from you for 7 days at any stage, the slot is released and no refund is given.

6. Delivery

Final artwork comes as high-resolution png and jpg (RGB) files. Layered files and timelapses are not included unless agreed in advance. Screen and print colors may differ, and I'm not responsible for printing results.

7. Usage Rights

• I keep the copyright at all times. You receive a non-exclusive license [worldwide, without time limit].

• Commercial use is included for the project named in the quote (e.g., the cover of the named book in all its editions and formats, plus marketing for that book).

• Not included without a separate agreement: merchandise, other books or series, resale or sublicensing, adaptations.

• Please credit me as the illustrator (@fox___glove.art).

• The artwork may not be used to train, fine-tune, or feed generative AI, and may not be used for NFTs or similar purposes, even with a commercial license.

• Layout adjustments (extending the background, resizing) are fine. Changes that alter the artwork's meaning are not.

8. Content Guidelines

I draw: character art, book covers, endpapers, sprayed edges, romantic and sensual scenes.

I don't draw: explicit sexual content, genitalia, or sexual acts. Nudity is limited to bare breasts at most. I also don't draw [hateful content / real people in nude or intimate scenes / ...].

All depicted characters must be adults (18+). By booking, you confirm this. I decline any request if I have doubts about age, consent, or the rights to the material.

9. No AI

All my artwork is created by hand. I use no generative AI in my process. You are not allowed to put the illustration in any AI provider.

10. Portfolio and Privacy

I may show finished work, sketches, and work in progress in my portfolio and on social media. If your project is under embargo (cover reveal, unpublished book), tell me before I start, and I'll wait until the agreed date. Your personal data (invoice details) is used only for processing your order (see my Privacy Policy).

11. Cancellation and Refunds

• Every artwork is custom-made, and my time is reserved for you from the moment you book. Therefore, all payments are non-refundable, including the deposit and the second payment. This applies if you cancel, change your mind about the project, or stop responding. By booking, you explicitly accept this.

• Exception: if I am unable to deliver your artwork (e.g., due to illness), I refund all payments for undelivered work, or we agree on a new deadline.

• After delivery, no changes to the price or refunds are possible.

12. Honorary Copy (optional)

For book covers and endpapers, I ask for one author copy of the finished book on top of the price. Shipping is at your expense. I also would love to get credit as the creator of the illustration

13. Consumer Rights and Disputes

If you are a consumer, your mandatory legal rights (including any right of withdrawal) remain unaffected. [Placeholder: withdrawal information and the required statement on out-of-court dispute resolution. Have this checked.] In case of disagreement, let's first try to solve it together.

 

14. Liability

I am liable without limitation for intent, gross negligence, and injury to life, body, or health. Otherwise, my liability is limited to typical, foreseeable damage and to the value of the commission.

 

15. Final Provisions

German law applies, except where mandatory consumer protection rules of your country of residence apply. If a provision is invalid, the rest stays in effect. The version valid at the time of booking applies to your commission.
